The Canada Border Services Agency (CBSA) has extended the re-investigation to update the normal values and export prices of certain copper pipe fittings from the United States, South Korea and China and the amounts of subsidy of certain copper pipe fittings from China.

The subject goods are defined as: solder joint pressure pipe fittings and solder joint drainage, waste and vent pipe fittings, made of cast copper alloy, wrought copper alloy or wrought copper, for use in heating, plumbing, air conditioning and refrigeration applications.

The re-investigation has been extended by 28 days and will now conclude by .

What is “valuation?”

A “value for duty” must be declared for all goods imported to Canada in accordance with the valuation provisions of the Customs Act (regardless of the circumstances of their importation. The value for duty is the base figure on which duty you may owe on your goods is calculated.

Even if you do not owe duty, the value for duty of goods must still be established so that any applicable assessment of the goods and services tax, provincial sales tax or harmonized sales tax may be calculated.

The copper pipe fittings that are the subject of the valuation are usually classified under the following tariff classification numbers:

  • 7412.10.00.11
  • 7412.10.00.19
  • 7412.10.00.90
  • 7412.20.00.11
  • 7412.20.00.12
  • 7412.20.00.19
  • 7412.20.00.90

These classification numbers may apply to goods which are not subject to SIMA measures, may change because of amendments to the Departmental Consolidation of the Customs Tariff, or the subject goods may be imported under tariff numbers that are not listed.

The Tribunal is excluding the following copper pipe fittings from its injury findings:

  1. 4 cast drainage lead 8 oz. closet flange;
  2. 4 cast drainage 14 oz. lead closet flange; and
  3. Copper-iron high-pressure alloy fittings manufactured with UNS C19400 grade copper alloy and with safe working pressure up to 1,740 psi.
