It\u2019s referred to differently &#8212; based on the country in question.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Canada, the agreement is <\/span><b>CUSMA: Canada-United States-Mexico-Agreement<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In the US, the agreement is <\/span><b>USMCA: United States-Mexico-Canada-Agreement<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In Mexico, the agreement is <\/span><b>T-MEC: <\/b><b>Tratado Mexico, Estados Unidos, Canada\u00a0<\/b><\/p>\n<p><a href=\"https:\/\/www.cbsa-asfc.gc.ca\/publications\/cn-ad\/cn20-14-eng.html\"><b>Here is the CBSA Announcement &#8211; Customs Notice 20-14.<\/b><\/a><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-4807\" src=\"https:\/\/clearit.ca\/canadian-customs-broker-blog\/wp-content\/uploads\/\/2020\/06\/NAFTA_logo.svg_-1024x837.png\" alt=\"cusma nafta\" width=\"500\" height=\"409\" srcset=\"https:\/\/clearit.ca\/canadian-customs-broker-blog\/wp-content\/uploads\/2020\/06\/NAFTA_logo.svg_-1024x837.png 1024w, https:\/\/clearit.ca\/canadian-customs-broker-blog\/wp-content\/uploads\/2020\/06\/NAFTA_logo.svg_-300x245.png 300w, https:\/\/clearit.ca\/canadian-customs-broker-blog\/wp-content\/uploads\/2020\/06\/NAFTA_logo.svg_.png 1252w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>As importers, it\u2019s important that you take note of the changes in this agreement and how it modifies the regulatory framework in which you operate. Today, we will be doing a breakdown of CUSMA and what it will mean for importers.<\/p>\n<p><span style=\"font-weight: 400;\">CUSMA will be in effect as of July 1, 2020. After this date, NAFTA certificates will no longer be accepted by customs authorities to reduce duties. Under CUSMA, a <\/span><a href=\"https:\/\/www.international.gc.ca\/trade-commerce\/assets\/pdfs\/agreements-accords\/cusma-aceum\/r-cusma-04.pdf\"><b>Certificate of Origin<\/b><\/a><span style=\"font-weight: 400;\">, with a few specifications included in the documentation will be required to benefit from this agreement.<\/span><\/p>\n<p>As of now, and perhaps going forward, there is no formal certificate to claim the benefits of CUSMA (like a NAFTA certificate equivalent), so it\u2019ll be up to the importer to get the other documentation right.<\/p>\n<h2><b>What will the Certificate of Origin need to include?\u00a0<\/b><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li><b><b>Importer, exporter, or the producer: <\/b><span style=\"font-weight: 400;\">the party certifying the origin.<\/span><\/b><\/li>\n<\/ul>\n<ul>\n<li><b>The certifier: <\/b><span style=\"font-weight: 400;\">the information for the party above<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>The exporter:<\/b><span style=\"font-weight: 400;\"> the identifying and contact information &#8212; including country!<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>The producer\/manufacturer: <\/b><span style=\"font-weight: 400;\">their information, including contact, country, etc.<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>The importer: <\/b><span style=\"font-weight: 400;\">information like contact, country, etc.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>Description of the goods and the HS Tariff Classification<\/b><\/li>\n<\/ul>\n<ul>\n<li><b>Origin criteria: <\/b><span style=\"font-weight: 400;\">Using CUSMA, identify the criterion that the goods qualify under.<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>Blanket period:<\/b><span style=\"font-weight: 400;\"> Stipulate if the certification should apply to multiple shipments of the same goods.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li><b>Authorized Signature and Date<\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><b>If imports previously benefited from NAFTA, will they also benefit from CUSMA?\u00a0<\/b><\/h2>\n<p>While NAFTA and CUSMA are certainly similar, they are not the same. It\u2019s critical that importers refer to the new set of regulations under the Rules of Origin to make sure that your commercial goods still qualify.<\/p>\n<p>The agreement breaks goods down by HS tariffs and stipulates various exemptions. It is advisable to review the new agreement and see how your goods fit into the Rules of Origin.<\/p>\n<h2><b>How do importers obtain a Certification?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The first step would be to ensure that manufacturers, suppliers, vendors, etc. that are based in the US or Mexico. Secondly, communicate with them to see that they are aware of the new agreement and how it impacts their operation &#8212; <\/span><b>are they ready for July 1st? Do their goods comply with the new rules? Are they ready to provide new documentation?\u00a0<\/b><\/p>\n<p>Much of the onus falls on them to ensure everything is in order. However, the importer has the ability to verify the elements mentioned above, so it might be a good option to be prepared.<\/p>\n<p>Importers can certify the imported goods, but that will mean that they are subject to a CBSA audit and must keep accurate documentation as such.<\/p>\n<h2><b>Will all imports be required to provide a certificate of origin?\u00a0<\/b><\/h2>\n<p>For shipments that are valued at less than $3300CAD: they will be exempt from providing this info. However, importers will still need to provide proof of origin in the event of a possible audit.<\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p>Naturally, certifications, agreements, regulations, etc. will change over time. All the more reason to link up with a customs broker that can help your organization manage these changes with ease.
