There are rules and regulations that all Canadians must adhere to when shipping items over the border, and the <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\"> are what the CBSA uses to penalize those who don\u2019t. The practice of following these rules is usually referred to as customs compliance. If you\u2019re a regular importer or exporter, customs compliance practices are vital to your operation. But what exactly happens when you violate a rule that the CBSA (<\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/www.cbsa-asfc.gc.ca\/menu-eng.html\"><span style=\"font-weight: 400;\">Canadian Border Services Agency<\/span><\/a><\/span><span style=\"font-weight: 400;\">) has put forth?\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What are the <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\">?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The AMPS or <\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/www.cbsa-asfc.gc.ca\/trade-commerce\/amps\/menu-eng.html\"><span style=\"font-weight: 400;\">Administrative Monetary Penalty System<\/span><\/a><\/span><span style=\"font-weight: 400;\"> is the system that the CBSA uses to give monetary penalties to importers and exporters for violating CBSA trade legislation. Simply put, they\u2019re a fine you\u2019ll have to pay to the CBSA if you\u2019re caught breaking shipping laws. The purpose of\u00a0 <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\"> is to deter non-compliance and to make sure that all businesses operate on a level playing field.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The penalties are essentially fines, and they don\u2019t result in a criminal record or prison time. <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\"> can be issued in combination with other kinds of fines. However, <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\"> will not be proposed if a customs violation is serious enough to warrant prosecution.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When you receive an AMPS penalty, your business profile will be marked and the violation will stay on CBSA records for three years. This could be costly, as your shipments will be watched more carefully, being often subjected to time-costly <\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/clearit.ca\/canadian-customs-broker-blog\/secondary-inspections\/\"><span style=\"font-weight: 400;\">secondary inspections<\/span><\/a><\/span><span style=\"font-weight: 400;\"> at the border. It also results in fees that could range from a nuisance to a serious impact on your operations, depending on the amount.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What violations result in <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\">?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are 152 different contraventions, or violations, that are punishable under AMPS. You can find a full list of all the contraventions and the associated monetary penalties on the <\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/www.cbsa-asfc.gc.ca\/trade-commerce\/amps\/mpd-dmi-eng.html\"><span style=\"font-weight: 400;\">Amps Master Penalty Document<\/span><\/a><\/span><span style=\"font-weight: 400;\">. According to the CBSA, these are the most common acts of non-compliance that result in <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Failure to pay duties;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Failure to provide required information to the CBSA;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Unauthorized removal of goods from a warehouse;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Direct delivery of goods prior to release from CBSA control;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Failure to report goods to the CBSA;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Failure to self-correct an incorrect declaration.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Out of the 152 contraventions, these are the penalty codes most frequently imposed on importers and exporters:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>C336<\/b> <span style=\"font-weight: 400;\">Person failed to pay duties on accounted goods. <\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C005<\/b> <span style=\"font-weight: 400;\">Person failed to provide true, accurate and complete information.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C082<\/b> <span style=\"font-weight: 400;\">Importer failed to correct tariff classification within 90 days.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C084\u00a0<\/b><span style=\"font-weight: 400;\">Importer failed to mark the goods.<\/span><b><br \/>\n<\/b><b>C151<\/b><\/li>\n<li style=\"font-weight: 400;\"><b>C066<\/b> <span style=\"font-weight: 400;\">Person removed unreleased goods from customs office or sufferance <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0warehouse.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C021<\/b> <span style=\"font-weight: 400;\">Carrier failed to report regular goods ($1,600 or greater).<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C353<\/b> <span style=\"font-weight: 400;\">Importer failed to pay duties as a result of a required correction.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C018<\/b> <span style=\"font-weight: 400;\">Failure to transport passengers and crew to customs office.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>C315<\/b> <span style=\"font-weight: 400;\">Exporter failed to provide any export permit required.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For some offences, such as C336, there is a flat rate. For others, such as C082, you could pay up to $25,000 CAD for a single offence. For most AMPS penalties, the fine increases depending on how many times you\u2019ve committed the offence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0Here\u2019s an example of the structure for violation C066:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400;\">1st offence<\/span><\/td>\n<td><span style=\"font-weight: 400;\">$1,000 CAD<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">2nd offence<\/span><\/td>\n<td><span style=\"font-weight: 400;\">$2,000 CAD<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">3rd and subsequent offences\u00a0 \u00a0 \u00a0<\/span><\/td>\n<td><span style=\"font-weight: 400;\">$4,000 CAD<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><b><br \/>\nNote:<\/b><span style=\"font-weight: 400;\"> On April 1st 2019, the fees of 22 contraventions increased significantly. You can find out more about the violations and the penalty increase through CBSA\u2019s <\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/www.cbsa-asfc.gc.ca\/publications\/cn-ad\/cn19-05-eng.html\"><span style=\"font-weight: 400;\">Customs Notice 19-05<\/span><\/a><\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How to respond to <\/span><span style=\"font-weight: 400;\">AMPS penalties<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If you are issued an AMPS penalty, you will receive the CBSA\u2019S <\/span><span style=\"color: #333399;\"><a style=\"color: #333399;\" href=\"https:\/\/www.cbsa-asfc.gc.ca\/publications\/forms-formulaires\/e650-eng.html\"><span style=\"font-weight: 400;\">Notice of Penalty Assessment (NPA)<\/span><\/a><\/span><span style=\"font-weight: 400;\">, form E650, which describes your violation and the associated fine. After that, you have a few options on how to proceed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You can choose to <\/span><b>pay the fine upfront<\/b><span style=\"font-weight: 400;\">. If you have no reason to correct or appeal the fine, you must pay it within 30 days. After 30 days, you\u2019ll start to incur interest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you disagree on the penalty issued to you, you can <\/span><b>request a correction or appeal<\/b><span style=\"font-weight: 400;\">. You must contact the CBSA office that issued the penalty within 90 days after receiving the notice. If you do this, the payment will be deferred until a decision has been made. However, should your correction or appeal be denied, you will be responsible for the full payment plus interest. You are also responsible for obtaining the release of imported goods, paying duties, preparing documents, maintaining records and responding the the CBSA should they contact you.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many choose to work with a customs broker to make sure their operations are compliant with CBSA regulations. If you hire a customs broker and receive an AMPS penalty, you will still be on the hook for it. The fine does not go to the customs broker. For this reason, it\u2019s important to hire a reputable customs broker. Don\u2019t risk it by going with a broker that cuts corners.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even if you use a customs broker, it\u2019s recommended that you are up to date and knowledgeable on CBSA customs laws yourself. You should be able to understand what a customs broker does and what violations could result in an AMPS penalty. That way, you\u2019ll be able to tell a good customs broker from a bad one.
